CLIENT TERMS AND CONDITIONS

This Client Terms and Conditions agreement (the “Agreement”) is made between Climax Recording Studio Limited (the “Studio”) and the client (the “Client”) using the Studio’s facilities and services. By booking a session, the Client agrees to the following terms:

1. DEFINITIONS

  • Client: The individual or entity booking and using the Studio's services.

  • Studio: Climax Recording Studio Limited, including its facilities, staff, and equipment.

  • Session: The period booked by the Client for studio use.

  • Force Majeure: Unforeseeable events beyond either party's control that prevent fulfillment of obligations.

2. BOOKINGS AND CANCELLATIONS

  • All bookings must be made in advance.

  • Clients must pay a deposit equal to the room fee at the time of booking.

  • Cancellation Policy:

    • More than 48 hours before the session: Full refund.

    • Between 48 and 24 hours before the session: 50% refund.

    • Less than 24 hours before the session: No refund.

  • Refunds will be processed within 5 business days.

  • If a session is delayed due to Studio-related issues (e.g., equipment failure, double bookings), the Client will be offered an extension or reschedule at no additional charge.

3. LATE ARRIVAL POLICY

  • Clients arriving more than 15 minutes late will not have their session extended to compensate for lost time.

  • If the Client is more than 30 minutes late without notice, the Studio reserves the right to shorten or cancel the session at full charge.

  • If the Client is more than one hour late without prior notice, the session will be deemed canceled without a refund.

4. PAYMENT AND FEES

  • Deposit must be paid before the start of the session.

  • Payments must be made via bank transfer or PayPal.

  • For large-scale commercial projects, the Studio may apply different pricing and payment terms, which will be outlined in a separate agreement.

5. CONFIDENTIALITY AND MEDIA USE

  • The Studio reserves the right to use media recorded on-site for promotional purposes unless otherwise agreed in writing.

  • Clients are encouraged to tag and credit the Studio in social media posts about the session.

  • The Client must obtain the Studio’s written approval before making public announcements about major projects recorded at the Studio.

6. LIABILITY AND INDEMNITY

  • The Studio is not liable for loss of personal belongings left in the space.

  • Clients are responsible for their own insurance for valuable equipment and personal belongings.

  • Any damage caused by the Client or their guests must be repaired or reimbursed at the Client’s expense.

  • Clients wishing to store equipment overnight must request approval in advance.

7. ALCOHOL, DRUGS, AND CONDUCT

  • No illegal substances, smoking, vaping or alcohol are permitted on Studio premises.

  • Any misconduct, including aggressive behavior or excessive intoxication, may result in immediate termination of the session with no refund.

  • The Studio reserves the right to refuse entry to additional guests beyond the agreed number.

8. FORCE MAJEURE (UNFORESEEN EVENTS)

  • The Studio will work with the Client to reschedule or refund the session in the case of cancellations or delays due to events beyond its control, including but not limited to:

    • Technical failures (e.g., power outages, software issues).

    • Natural disasters (e.g., flooding, fires, extreme weather).

    • Venue-wide closures or emergencies.
